Terms of Service

1. Acceptance of these Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy & Security policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate account information and notify us promptly of any unauthorized use. You may not share your account or let others access it.

4. How the Service works (approval-first)

Vinskal prepares drafts and organizes your applications. Employer-facing actions — such as filling approved fields on an application site, attaching approved files, sending email, or submitting an application — happen only after you review and explicitly approve them. The browser extension does not browse or scrape job boards in the background. On supported application sites, it may temporarily observe application-question responses as the page loads so those questions are available if you choose to capture the posting. Capturing a job, filling approved fields, attaching files, and any employer-facing action remain user-controlled. Where final submit is supported, it requires an explicit preview and your confirmation — the Service never silently submits applications and never mass-applies on your behalf. This approval requirement covers employer-facing messages and submissions; operational messages — such as sign-in verification, security and account notices, password resets, and reminder digests you have enabled — are sent by the Service itself and are not employer-facing.

5. Your responsibility for accuracy

You are responsible for the truthfulness of everything you submit to employers. Vinskal helps you organize and draft materials, but you must review and approve them before use. Do not submit false, misleading, exaggerated, or plagiarized information.

6. Application terms and employer rules

You are responsible for following each employer's and job platform's terms, as well as applicable laws. Vinskal assists with drafting and organization; it does not bypass employer rules, CAPTCHAs, identity checks, or application limits on your behalf.

7. Acceptable use

• Do not post fake, spam, or abusive job listings to community job listings, or file bad-faith reports.
• Do not attempt to access other users' data, accounts, or admin functionality.
• Do not use the Service to harass, defraud, or impersonate others.
• Do not use the extension or API to scrape sites, bypass security controls, fill unsafe fields, or submit without the review and confirmation flows the Service provides.
• Do not scrape, reverse-engineer, overload, or disrupt the Service or its security.
• Repeated or serious abuse may result in warnings, restriction, suspension, or termination.

8. Your content and ownership

You retain ownership of the information and materials you create or upload. You grant Vinskal a limited license to store, process, and display that content solely to operate and provide the Service to you (for example, generating drafts you request or storing materials you upload). You are responsible for ensuring you have the rights to any content you provide. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you. We may also create and use de-identified and aggregated data derived from your use of the Service to operate, secure, and improve it, consistent with our Privacy & Security policy.

9. AI-generated content and job-trust signals

The Service uses AI to produce drafts and advisory job-trust analysis. AI output can be inaccurate, incomplete, or unsuitable, and is provided for your review only. Trust scores and risk indicators are informational — they can produce false positives and false negatives and do not guarantee that a job or recruiter is legitimate. You must independently verify employers and postings. You are solely responsible for reviewing, editing, and approving any content before you use or submit it. Vinskal does not guarantee any outcome, interview, or job offer.

10. Intellectual property

The Service, including its software, design, and trademarks, is owned by Vinskal and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, or create derivative works of the Service except as permitted by law.

11. Third-party services

The Service may rely on or link to third-party services (such as AI providers, hosting, payment processors, Google sign-in, optional Gmail access, and application sites you visit). We are not responsible for third-party services, and your use of them is subject to their own terms. Vinskal uses Gmail access, when you enable it, only to read status signals you request and to create follow-up drafts you request. Although the OAuth scope technically permits sending, Vinskal does not use Gmail's send methods; you send the draft yourself from Gmail. Outbound email uses Vinskal's configured email provider, not Gmail send access.

12. Fees and billing

Vinskal offers Free, Plus, Pro, and Ultra plans with different monthly AI usage limits and features. Paid plans renew automatically until canceled. Before subscribing, you are shown the applicable plan, billing period, and price at checkout. You can manage or cancel a subscription from the Billing & plan page, which opens the Stripe customer portal; cancellation takes effect at the end of the current paid period unless otherwise stated at checkout. Refunds, if any, follow the policy shown at purchase or as required by applicable law. Taxes may apply where required.

13. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in the Service is legal, financial, tax, employment, or immigration advice. Outcomes depend on many factors outside our control.

14. Limitation of liability

To the maximum extent permitted by law, Vinskal and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising out of or related to your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD $50.

15. Indemnification

You agree to indemnify and hold harmless Vinskal and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

16. Termination

You may stop using the Service and delete your account at any time from Account & Settings. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will continue to apply.

17. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we will update the date above and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the Vinskal operator is established, without regard to its conflict-of-laws rules. Before bringing any claim, you agree to first email [email protected] and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the courts located in that jurisdiction, and you and Vinskal consent to personal jurisdiction there — except where mandatory consumer-protection law in your place of residence provides otherwise.

19. Changes to the Service

We may add, change, suspend, or discontinue features of the Service at any time, including plans and usage limits. Except as required by applicable law, we are not liable to you for any modification, suspension, or discontinuation of the Service.

20. General

These Terms and the Privacy & Security policy are the entire agreement between you and Vinskal regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, financing, or sale of assets. These Terms create no third-party beneficiary rights.
